Effective: 8/19/26 | Subject to revision. PLEASE READ THIS AGREEMENT CAREFULLY BEFORE SUBSCRIBING FOR MEMBERSHIP. BY SUBMITTING A MEMBERSHIP APPLICATION, MAKING ANY PAYMENT, OR ACCESSING CLUB FACILITIES, YOU AGREE TO BE BOUND BY ALL TERMS OF THIS AGREEMENT.
Section 1 — Parties, Definitions, and Acceptance
1.1 Parties: This Membership Agreement ("Agreement") is entered into between Royal Resort, LLC Doing Business as Apple Mountain Country Club, a New Jersey limited liability company with its principal place of business at 369 Hazen Oxford Rd, Belvidere, Warren County, New Jersey 07823 ("Club," "AMCC," "Management," "we," "us," or "our"), and the individual or household submitting a membership application ("Member," "you," or "your").
1.2 Definitions: "Club Facilities" means all physical premises, amenities, structures, outdoor spaces, common areas, parking, and services located at or operated by Apple Mountain Country Club, including but not limited to the driving range, putting greens, mini golf course, restaurant, bar, coffee shop, pro shop, lodging accommodations, lounge, and any future amenities such as an 18-hole golf course, disc golf course or any other facilities and amenities provided in the future.
1.3 Acceptance: By submitting a membership application, making any membership payment, activating a membership, or accessing Club Facilities in any capacity, you acknowledge that you have read, understood, and agree to be bound by all terms and conditions of this Agreement, including all incorporated policies and Rules and Regulations.
1.4 Legal Capacity: By entering into this Agreement, you represent and warrant that you are at least 18 years of age, that you have the legal capacity to enter into a binding contract, and that all information provided in your membership application is true, accurate, and complete.
Section 2 — Membership Tiers and Benefit Summary
Apple Mountain Country Club offers four (4) membership tiers: Social Member, Heritage Member, Legacy Member, and Founder Member. All benefits are subject to the terms, limitations, exclusions, and disclaimers set forth throughout this Agreement.
2.2 Trial Operations & Closure Policy: Member acknowledges and agrees that Apple Mountain Country Club is currently operating during an initial or trial operating period. The Club reserves the right to modify, reduce, temporarily suspend, or discontinue Club operations or permanently cease operations. Dues for prior available periods are non-refundable except where required by law.
2.3 TrackMan Range: TrackMan hours: Social 2 hrs/mo, Heritage 6 hrs/mo, Legacy 10 hrs/mo, Founder Unlimited.
2.4 Member Discounts: Food discounts (Social 5%, Heritage 8%, Legacy 12%, Founder 15%) exclude alcoholic beverages and gift cards.
2.5 Mini Golf & Putting Greens: Unlimited complimentary mini golf for all tiers. Unlimited putting greens access (Opening Fall 2026).
Section 3 — Fees, Payment, and Billing
3.1 Initiation Fees: Initiation fees are due at enrollment, non-refundable and non-transferable under any circumstances, including cancellation of membership for any reason.
3.2 Monthly Fees: Monthly membership fees are billed in advance on each Billing Date. All fees are exclusive of applicable New Jersey state and local taxes.
3.3 No Refunds; No Prorations: ALL FEES PAID TO THE CLUB ARE STRICTLY NON-REFUNDABLE. Members expressly waive any right to seek a chargeback or refund through any payment processor or credit card issuer.
3.4 Failed Payments: If any payment is declined, a second attempt is made within five (5) days. Uncollected accounts are placed in Suspended status. A reactivation fee of $25 may be assessed.
3.5 Automatic Renewal & Cancellations: Monthly memberships renew automatically. Cancellation requests must be sent in writing at least 3 days prior to the billing date by submitting a written request or emailing ContactUs@AppleGolfClub.com.
Section 4 — Credits, Discounts, and Benefit Limitations
4.1 Discounts: Member discounts apply only to eligible purchases made at Club-operated outlets during active membership and exclude alcohol and gift cards.
4.2 Driving Range: Subject to advance reservation, availability, and session caps (max 6 persons per bay). Minors under 16 must be accompanied by an adult. All driving range bays feature TrackMan technology.
4.3 Mini Golf: Unlimited complimentary mini golf for all tiers subject to course availability. Non-Members pay $5 per round.
4.4 18-Hole Golf Course: Estimated opening Summer 2027 (not guaranteed). Cart and additional fees apply upon opening.
Section 5 — Family and Household Member Add-Ons
5.1 Add-On Rates: Spouse or Domestic Partner — $40/month; Child under 18 — $15/month; Children under 8 — No charge when accompanied by a Member; Young Adult (ages 18–22, enrolled student) — $25/month. Household Member add-ons share tier range hours and benefits.
5.3 Removing Household Members: Primary Member must provide thirty (30) days prior written notice to the Club. No mid-cycle refunds or prorations.
Section 6 — Cancellation, Pauses, and Eligibility
6.1 Cancellation: Month-to-month members may cancel by providing written notice at least 3 days prior to their billing date or emailing ContactUs@AppleGolfClub.com.
6.2 Membership Pause: Freeze up to two (2) months per rolling 12-month period. Request in writing no fewer than seven (7) days before Billing Date.
6.3 Club Discretion & Termination: Membership is a conditional privilege. The Club reserves the right to approve, decline, suspend, or terminate membership for rule violations, safety concerns, abusive conduct, dishonesty, or intoxication.
Section 7 — Club Rights, Guest Policies, and Conduct
7.1 Right to Modify: Club reserves the absolute and unilateral right to modify amenities, services, operating hours, or programs at any time without refund.
7.5 Guest Policies & Member Responsibility: Members are responsible for guest conduct and compliance with Club rules. Misconduct by a guest may result in restriction, suspension, or termination of sponsoring member privileges. Guest fees may apply in future.
Section 8 to 15 — Disclaimers, Liability, Arbitration & Terms
8.1 Disclaimers & Warranties: Facilities and services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
9.2 Cap on Damages: Total aggregate liability of the Club is capped at total membership fees paid in the preceding three (3) months.
11.1 Mandatory Binding Arbitration & 5-Day Claim Limit: All disputes resolved via binding AAA arbitration in Warren County, NJ. Any claim must be submitted to arbitration or court no later than five (5) days from when the member knew or reasonably should have known of the facts.
